Notes
The ammunition that was found in Patricia's home and the shell casings found inside the tent--undoubtedly from her gun--were brass. The silver shell casings found at the campsite were from other people in the area.
#33 - It is possible that detectives couldn't tie the empty vodka bottle to the crime after it had lain out in the rain for several days.
#45a-d - It is possible that the pullover found along the creek could not be tied to the crime scene and my have been lost by someone else.
#49a-b - Chris' iPhone and charger were withdrawn from evidence because they were not important to the case. What was important was the report of the messages and phone calls extracted from his phone by Sergeant Colin Fagan.
#50a-b - As with Chris' iPhone, Patricia's cell phone was withdrawn from evidence because it not important to the case. What was important was the report of the messages and phone calls extracted from her phoneby Sergeant Colin Fagan.
#65a-c - Probably could could not be tied to the crime scene or to the victim.
#73a-d - In her testimony, Amber said that when they got to the campsite, Patricia fired a single bullet into tree. Detectives told us that although they did find two bullets imbedded in trees at the campsite, neither bullet was consistent with Patricia's handgun.
#82 - Mr. Allison withdrew the diagram of the gunshot wounds suffered by Chris because he thought it was too disturbing for the jury. He told us that in his experience, sometimes juries become angry at the prosecution for making them view evidence that is too graphic. For the same reason, Mr. Allison did not put photographs from the autopsy into evidence.
#84 - Chris was at times donating blood to earn extra money. Mr. Allison told us that he was considering entering the amount paid to Chris for his blood donations into evidence. That information would show the jury how committed he was to getting back together with Patricia. However, they found that the total amount from the time that he and Patricia reconciled was so small, that it didn't really matter.
#130 - For the same reasons as #82, the CD of the forensic exam was withdrawn because Mr. Allison thought it would be too upsetting for the jury to see.
#131 - Due to objections by Mr. Duncan, this printout of text message conversations was withdrawn, edited according to Judge Dixon's instructions, and resubmitted as exhibit #132.
#160 - Was revised according to Judge Dixon's instructions and resubmitted as #193.
#190 - The 21 photographs taken at Patricia's home during the search on November 21, 2012, showed piles of laundry and other examples of poor housekeeping. Judge Dixon ruled that the pictures showing nothing but a messy house could not be shown to the jury, in case they would be prejudicial to Patricia. Ten of the photographs were removed and the remaining 11 were admitted into evidence as #191.
#192 - Ben Jump testified that he was with Kris Lubbers at Kris' home the evening that Chris was killed, using his Google Conversation records to remind himself as to when he arrived and when he left. Once he testified, there was, apparently, no longer any need for this exhibit.
Exhibit A for the defense was in the court file and did not need to be submitted into evidence.
